Consultancy and training booking terms and conditions

These Terms and Conditions shall come into effect when either 1) Customer completes the Online Booking Process or 2) On receipt by The CBT Resource of an agreement of works (dates, email request, PO number or equivalent) in any format.​

  • The CBT Resource will use reasonable endeavours to supply the training or consultancy in accordance with these Terms and Conditions in all material respects but reserves the right to change the content at any time and without any notice.

  • Training or consultancy may not be cancelled or rescheduled within 30 days of the date of delivery (or in the case of multiple date bookings, the first date in the delivery schedule) under any circumstances. A charge of 50% for administrative costs will be applied where cancellation is made 6 months or more prior to the date of delivery or first date of delivery for multiple date schedules. A charge of 75% is made if this occurs within twenty (20) weeks prior to delivery. If training or consultancy is cancelled within 30 days of the first delivery date or after a PO number is received no refund will be given and 100% of charges will apply. Your decision must be sent to us in writing or email to The CBT Resource administrator (mail@thecbtresource.co.uk) at least thirty (30) days prior to the first scheduled date or commencement of works. 

  • A customer may make one change to a date to a booking prior to 30 days of the delivery, only if availability allows. No changes can be made within 30 days of delivery date (in the case of multiple bookings, from the date of  first delivery on the schedule). 

  • Any discounts applied for multiple date training will be removed if any dates are cancelled prior in line with the terms and conditions. An invoice will be sent for the charge and any outstanding amount as a result with a request to pay within 14 days applied. 

  • The CBT Resource reserves the right to cancel any consultancy or training prior to 30 days before the commencement of works, without incurring additional liability to the Customer or any Delegates for circumstances outside of our control. In such circumstances, The CBT Resource will offer (at its sole discretion) alternative dates, a full refund or a credit note. 

  • Should your training be unable to be delivered due to COVID-19, we will enable dates to be rearranged on one occasion and/or providing an online provision instead of face to face where applicable. 

  • The customer or delegate is obliged to provide all relevant payment and/or invoicing information in advance of any booking being confirmed. Booking is confirmed as final when dates are set and/or a Purchase Order is received, whichever is earliest. 

  • Consultancy is confirmed as booked upon confirmation of dates or the commencement of work, whichever occurs first. 

  • Our payment terms are 14 days unless otherwise agreed in writing at time of booking conformation. 

  • Without prejudice to any other right or remedy it may have, if the Customer fails to pay The CBT Resource any sum due on or before the due date the Customer will pay interest on the overdue sum from the due date until payment of the overdue sum, whether before or after judgement. Interest under this clause will accrue each day at 5% a year above the Bank of England's base rate. Should debt collectors be required to recover unpaid invoices, the customer will be responsible for all costs. 

  • If a customer or delegate fails to attend all or part of any training, full payment of the charges is still required.

  • If a refund is approved by The CBT Resource, it will be made through the original payment method only.

  • Without affecting any other right or remedy available to it, The CBT Resource may terminate the agreement with immediate effect if the Customer fails to pay any amount due under the agreement.

  • Without affecting any other right or remedy available to it, either party may terminate with 30 calendar days notice any agreement in the following circumstances only: The other party takes any step or action in connection with its entering administration, provisional liquidation, bankruptcy or any composition or arrangement with its creditors, being wound up, having a receiver appointed or the other party suspends, or threatens to suspend to cease to carry on all or a substantial part of its business or its financial position deteriorates to such an extent the obligations in any agreement cannot be fulfilled. 

  • All intellectual property rights in or arising out of connection with the consultancy or training, including all training materials or consultancy outputs shall be owned by The CBT Resource. No reproductions, scans, copies (wholly or in part) shall be made of the material without the prior written consent of The CBT Resource and these materials cannot be used for teaching or training purposes by any other party.

  • Each party may be given access to confidential information from the other party in order to perform its obligations under the agreement. Each party shall hold the other's confidential information in confidence and not make the other's confidential information available to any third part, or use the other's confidential information for any purpose other than the implementation of the agreement. A party may disclose confidential information to the extent that is required to be disclosed by law, by any governmental or other regulatory authority or by a court or other authority of competent jurisdiction, provided that, to the extent that is legally permitted to do so, it gives the other party as much notice of such disclosure as possible. The Customer acknowledges that its information may be used by The CBT Resource on an anonymous basis without limitation including compiling and publishing reports. 

  • The CBT Resources total aggregate liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the agreement shall be limited to the total charges paid for the training or consultancy. 

Data Privacy Notice

 

Privacy is of the upmost importance to The CBT Resource and Wix.com who provide this website for The CBT Resource. For the purposes of GDPR Wix is the "Processor" and The CBT Resource is the "Controller" of data. We welcome the General Data Protection Regulation (also known as GDPR) which was approved and adopted by the European Union (EU) in 2018. This notice applies to our website, downloads, purchases and subscriptions. The CBT Resource is a Consultancy, Resources & Training provider. The Data Protection Officer is: Marie Chellingsworth. What information do we collect?
For browsers on this website location, IP address, and number of visits is collected by Wix Websites for evaluation of website performance. If users register on The CBT Resource website by filling in the online form to join our mailing list or become a member we collect email addresses and name and this is completed through a secure server (HTTPS/SSL). If users subscribe to our monthly CPD club by completing the registration form, we collect contact information. If purchases are made all sensitive personal data or financial information is handled by Stripe secure payments provided as a third part provider by Wix services, not handled directly by The CBT Resource. Wix is Payment Card Industry Data Security Standards (PCI DSS) compliant and is accredited as a level 1 service provider and merchant. Wix regularly perform internal security audits to maintain their ISO/PCI security certifications. Wix securely handles site visitors' date in line with sections 4, 12 and 13 of their privacy policy detailed here: Social media features and framed pages include certain social media features, such as the "Facebook Connect", "Google Sign-in", "Facebook like", or "Share This" button or other interactive mini-programmes. These features may collect certain Personal Information such as your IP address or which page you are visiting on our website and may set a cookie to enable them to function properly. Social Media Features are either hosted by a third part or hosted directly on Wix Services. Your interactions with these third parties 'Social Media Features' are governed by their policies, not ours. In addition, our Services may enable you to share your Personal Information with third parties directly, such as via page framing techniques to serve content to or from Third-Party Service Providers or other parties, while preserving the look and feel of our website and Services ("Frames"). We do not share your personal data with any other parties outside of The CBT Resource website and Wix Services including third party services that are contracted by Wix for the operation of their services and Social Media Features described above.

They also regularly monitor their system for possible vulnerabilities and attacks and regularly seek new ways and third party services to further enhance their security of their services and protection of users privacy. Wix and The CBT Resource value the security of both customer and User of User Personal Information and do everything in our power to protect it. However, we cannot guarantee absolute protection. We encourage you to be careful, set a strong password for your account and avoid submitting any sensitive information, which, if exposed, could cause you major harm.  

How long do we keep your personal data for?

We retain data strictly for no longer than reasonably necessary. The criteria we will apply to determine how long to keep the data for is in accordance with local laws and contractual obligations. We securely dispose of data after we no longer need it. Wix and The CBT Resource may keep your personal information for as long as your account is active, and longer as needed, for example, if legally obligated to keep it longer, or need to protect our interests. Under the GDPR,  we respect the right of data subjects to access and control their personal data. You have a right in respect of:

•    correction and deletion of your personal information 
•    withdrawal of consent
